Article 78 Proceedings
There are times when a municipality or governmental agency has taken some sort of legal action against you or has rendered a decision against you. There are other times when a municipality or governmental agency has failed to perform a function that it is mandated by law to perform. If any of these situations occur, you can fight back with an Article 78 proceeding. Typically, an Article 78 proceeding is an action commenced in a New York State Supreme Court to request the court's intervention to overturn the municipality's or governmental agency's decision or to ask the court to order the municipality or governmental agency to perform a function that by law, they are mandated to perform.
